Terms of Service

These Terms govern your use of hertspulse.co.uk (the “Service”), operated by BubblyBrainApps (“Herts Pulse”, “we”, “us”). By accessing or using the Service you agree to these Terms. If you don't agree, don't use the Service.
1. Who can use the Service
You must be at least 16 years old. If you are using the Service on behalf of a business, you confirm that you have authority to bind that business to these Terms.
2. What the Service does
Herts Pulse is an online directory of businesses in Hertfordshire, England. We provide:
- Free listings auto-generated from public information (Companies House, Google Places, OpenStreetMap, etc.).
- The ability for business owners to claim and edit their listings.
- Paid “Featured” and “Premium” subscription tiers with additional features.
- AI-generated descriptions and editorial content, clearly labelled.
- A lead-capture form letting customers contact businesses through the site.
3. Accounts and security
- You sign in via a magic link or “Continue with Google”. You are responsible for keeping the associated email or Google account secure.
- Don't share your account with anyone or claim a listing you don't own or have authority over.
- We may suspend or terminate accounts that violate these Terms.
4. Claiming a listing
To claim a listing you must be the business owner or an authorised representative. By claiming, you confirm this. We reserve the right to require evidence (e.g. a business email matching the listing's domain, or proof of registration).
5. Content you submit
You retain ownership of content you submit (descriptions, photos, reviews, replies). By submitting, you grant Herts Pulse a worldwide, royalty-free licence to host, display, adapt, and distribute that content on the Service and in derived materials (e.g. blog round-ups featuring your business). This licence ends when you delete the content, except where it has been distributed off-platform (e.g. cached by search engines).
You must not submit content that is:
- False, misleading, or deceptive
- Infringing on intellectual property rights
- Defamatory, abusive, harassing, hateful, or unlawful
- Spam, malware, or contains links to malicious content
- An attempt to manipulate rankings (e.g. fake reviews)
We may remove any content at our discretion. Where reviews are concerned, we do not guarantee that all reviews are genuine — we apply reasonable moderation but cannot verify every submission.
6. AI-generated content
Some listings, blog posts, and search responses are generated by AI from public data and your submissions. AI-generated content is labelled with a sparkle indicator. We strive for accuracy but errors are possible. If you find inaccurate information about your business, email hello@hertspulse.co.uk and we will correct it promptly.
7. Paid subscriptions
- Featured and Premium tiers are billed monthly via Stripe. Prices are listed at /pricing.
- Subscriptions renew automatically until cancelled. You can cancel at any time via the customer portal; cancellation takes effect at the end of the current billing period.
- We will give 30 days' notice of any price changes.
- Consumer cancellation right: under the Consumer Contracts Regulations, consumers have a 14-day right to cancel digital services. By accepting these Terms when you start a paid subscription, you consent to the service starting immediately and acknowledge that you lose the 14-day right once the service has begun. Where required by law, refunds will be calculated pro rata for the unused portion of the cancellation period.
- No refunds are given for partial months once a billing period has begun, except as required by UK consumer law.
8. Acceptable use
You must not:
- Scrape, copy, or republish material from the Service except via our public APIs or with permission
- Use the Service to send unsolicited marketing
- Reverse-engineer, decompile, or attempt to extract source code
- Interfere with security features, rate limits, or other technical measures
- Use the Service to compete directly with Herts Pulse
9. Third-party content and links
Listings include links to businesses' own websites and social profiles. We don't endorse them, are not responsible for their content, and you use them at your own risk.
10. Intellectual property
The Service's design, code, branding (“Herts Pulse” name and logo), and editorial content are owned by BubblyBrainApps or licensed to us. You may not use these without written permission.
11. Disclaimers
The Service is provided “as is” and “as available”. We do not warrant that:
- The Service will be uninterrupted or error-free
- Listing information is complete or up to date (especially for unclaimed listings)
- AI-generated content is factually accurate in every case
- Reviews reflect the views of any particular customer
To the maximum extent permitted by law, we exclude all implied warranties. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded by law.
12. Limitation of liability
Subject to the paragraph above, our total liability to you arising out of or in connection with the Service is limited to the greater of (a) the amount you paid us in the 12 months prior to the event giving rise to the claim, or (b) £100. We are not liable for indirect, consequential, or loss-of-profit damages.
We are not responsible for transactions or disputes between you and any business listed on the Service.
13. Indemnity
You agree to indemnify Herts Pulse against any claims, costs, or damages arising from your breach of these Terms or your unlawful use of the Service.
14. Suspension and termination
We may suspend or terminate your access at any time for breach of these Terms. You can close your account at any time by emailing us. Termination doesn't affect rights or obligations accrued before termination, including any unpaid subscription fees.
15. Changes to these Terms
We may update these Terms. Material changes will be highlighted on the Service or notified by email. Continued use after a change means you accept the new Terms.
16. Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except that consumers may bring claims in their country of residence where required by law.
